These terms govern your use of Smart Web Works' services, including the website at smartwebworks.com.au and the AI Brain platform at app.smartwebworks.com.au. By using the service, you agree to these terms.

Your account
To use AI Brain, you need to create an account via an invite. You're responsible for keeping your login credentials secure and for anything done under your account. Let us know immediately if you suspect unauthorized access.
What you can do with the service
You may use AI Brain to manage messages and enquiries for your legitimate business. You may not:
- Use the service for anything illegal, harmful, or deceptive
- Send spam, unsolicited marketing, or abusive messages
- Try to break into other accounts or access data you're not entitled to
- Reverse engineer, copy, or resell the service
- Use the service to violate anyone else's rights
AI-generated content
AI Brain drafts replies using artificial intelligence. You are responsible for reviewing and approving every message before it sends. While we work hard to make the AI accurate and helpful, it can make mistakes — so always check before approving.
Your content
You own the content you put into AI Brain (business information, messages, replies). You grant us a limited licence to store, process, and display that content for the purpose of providing the service to you.
Our content
The AI Brain software, website, branding, and documentation are owned by Smart Web Works. You can't copy or redistribute them without permission.
Third-party services
AI Brain connects to services like SMS providers, email providers, and AI models. Those services have their own terms. We're not responsible for what those providers do with data they receive as part of providing their service.
Payment and billing
If you're on a paid plan, you'll be billed as agreed. You can cancel at any time. We don't offer refunds for partial months unless something is clearly broken on our side.
Service availability
We do our best to keep the service running smoothly, but we can't guarantee 100% uptime. We may occasionally take the service down for maintenance. If you're affected by an outage, email us and we'll make it right where we reasonably can.
Termination
You can delete your account at any time. We can suspend or terminate your access if you violate these terms, abuse the service, or fail to pay. We'll give you reasonable notice where we can.
Limitation of liability
To the maximum extent permitted by law:
- The service is provided "as is" without warranties of any kind
- We're not liable for indirect, incidental, or consequential damages
- Our total liability in any 12-month period is limited to the fees you paid us in that period
Nothing in these terms excludes your rights under the Australian Consumer Law that can't legally be excluded.
Changes to the terms
We may update these terms from time to time. If we make material changes, we'll notify you by email or via a notice in the app. Your continued use after changes means you accept the new terms.
Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be handled in the courts of Victoria.
